BASES

INDUSTRIAS TOBÍA S.A. (here in after NATURAL SLEEP) guarantees its BASES to the original purchaser of the product, subject to these terms and conditions.

COMMERCIAL WARRANTY OF UP TO 5 YEARS

Five year limited commercial warranty. Prior notification from year 3 to year 5 from the start date of the guarantee, NATURAL SLEEP will replace, under the terms and conditions mentioned in this paragraph, all defective parts that prevent the proper functioning of the mattress.

 

All electrical and/or electronic components and motors are excluded.

 

The buyer shall pay 1/3 of the cost of repairing the defective parts multiplied by the number of years after three years from the start date of the warranty and NATURAL SLEEP will bear the rest of the cost of repairing the defective part.

 

This 5-year warranty will be applicable as long as the defective part is returned to NATURAL SLEEP within 10 days after receipt by the buyer of the replacement part. The buyer will pay all service charges and transportation costs associated with the exchange of the defective part.

 

After 3 years from the warranty start date, the purchaser shall bear all costs of repair and replacement of all parts and materials, including labor and transportation.

WHAT IS THE DURATION OF THE MANUFACTURING WARRANTY?

All NATURAL SLEEP® products are covered by a 3-year General Manufacturing Warranty with the limitations described in this warranty for the entire Spanish territory.

NATURAL SLEEP bases are guaranteed against defects in workmanship or materials for a period of one year from the date of guarantee. Upon notification, during the first year from the warranty date, NATURAL SLEEP will repair or replace (at no cost to the purchaser) all defective parts that prevent the proper functioning of the box spring.

The guarantee is valid from the date of purchase.

WHAT DOES OUR WARRANTY COVER?

The repair or replacement of a bed base or any of its components under this guarantee will apply to the original date of the guarantee and may not extend the initial guarantee.

The decision to repair or replace defective parts under this warranty will be made solely and exclusively by NATURAL SLEEP.

Repair or replacement will be the buyer's only alternatives.

NATURAL SLEEP makes no other warranties, express or implied, and all implied warranties of merchantability for a particular purpose shall be disclaimed by NATURAL SLEEP and excluded from this agreement.

WHAT IS NOT COVERED BY WARRANTY?

The manufacturer will not be responsible for motor failures caused by undue overloads in the head and foot areas (such as overload caused by sitting in said areas).

Additional terms and conditions, this warranty excludes: (a) all defects caused by the purchaser; (b) repairs or replacement of any part of the box spring made by an unauthorized person; (c) incorrect handling (whether by transport or other agents), physical or electrical abuse or misuse, accumulated dirt, exposure to water, fire or other external agents; (d) damage to cables, electrical wires or other materials provided by the distributor; (e) all modifications made to the bed bases without the prior written authorization of NATURAL SLEEP; (f) costs of unnecessary telephone calls, travel costs for the sole purpose of showing the consumer how the mattress works or for having a bad connection.

NATURAL SLEEP will disclaim all liability for indirect, incidental or consequential damages, claims or losses, not expressly covered by the terms of this warranty.

This warranty does not cover reimbursement for inconvenience, travel, installation, start-up times, loss of use, transportation, or any other cost or expense. NATURAL SLEEP or its Technical Service will not be responsible for moving the furniture, removing headboards and footboards, or any other element to be able to carry out its work on the bed base. It is the sole responsibility of the buyer to provide the necessary space and accessibility.

In the case in which the Technician could not carry out his work due to poor accessibility, the service must be rescheduled and the buyer will be billed.

MATTRESSES

NATURAL SLEEP® manufactured individually, so there may be some slight variations between different products of the same reference.

WHAT IS THE DURATION OF THE MANUFACTURING WARRANTY?

All NATURAL SLEEP® products are covered by a 3-year General Manufacturing Warranty with the limitations described in this warranty for the entire Spanish territory.

In accordance with the provisions of article 125.3 of the General Law for the Defense of Consumers and Users, it is expressly indicated that the Commercial Guarantee does not affect the legal rights of the consumer and user due to the lack of conformity of the products with the contract .

The guarantee is valid from the date of purchase.

COMMERCIAL WARRANTY OF UP TO 10 YEARS

NATURAL SLEEP products have an additional three-year commercial guarantee prorated as follows:

- Commercial guarantees of up to 10 years will be reduced, on the invoice amount without VAT, by 12.5% each year from the third year.

- The commercial guarantees of up to 5 years will be reduced, on the invoice amount without VAT, by 33.33% each year from the third year.

These conditions, whenever repair is not possible, will apply to the acquisition of a NATURAL SLEEP product of equal or lesser value, always through the same store where it was purchased.

WHAT DOES OUR WARRANTY COVER?

The guarantee covers physical defects or changes that cause a visible and permanent deformation of more than 2 cm in the material (not including pillows).

The outer cover of the mattress is guaranteed for 3 years from the date of purchase as long as there are defects in materials or manufacturing.

If NATURAL SLEEP were to replace the mattress cover, it would be replaced by the existing cover for that mattress at that time, which may be a different color or material than the original cover.

WHAT IS NOT COVERED BY WARRANTY?

The guarantee does not cover products that are very dirty and in inadequate hygienic conditions or when a NATURAL SLEEP product has been modified or repaired without the authorization of NATURAL SLEEP.

When the NATURAL SLEEP instructions regarding the use, cleaning and maintenance of the product have not been followed; or when the product has been damaged as a result of poor maintenance, improper use or any other reason.

The warranty does not cover normal changes in firmness or properties that do not affect the pressure relief characteristics of the product.

The guarantee will be valid exclusively when the NATURAL SLEEP product is used with the base or box spring recommended by authorized NATURAL SLEEP distributors, if no repairs have been made to the product by persons not authorized by NATURAL SLEEP; and as long as it is not proven that the damages suffered in the NATURAL SLEEP product have been caused intentionally or as a consequence of improper or illegal use of the same.

This guarantee does not cover firmness variations less than or equal to +/- 15% over the nominal firmness in accordance with ISO 3386.

TECHNICAL SERVICE

The displacement of the Technical Service (if necessary) during the product guarantee period is free as long as the conditions of the same are met. In the case of claims not covered by the guarantee, the amount of the trips will be charged in the same way as if the product were outside the guarantee period (€50 VAT included). The cost of the repair out of warranty or in cases not covered by it, will be determined in each case.

STEPS IN CASE OF INCIDENT

You must first contact the dealer where you purchased the product. They will be in charge of notifying us of the problem and contacting an agent who will visit you if necessary.
